The Peach Studio Economic Terms

This Economic Terms(“Econ Terms”) governs how you may access, purchase and use The Peach Studio Paid Services. (“Paid Services”). These Econ Terms apply in addition to The Peach Studio User Agreement & Terms and Conditions (the “Terms”), which you have already agreed to, and includes certain terms that are defined in the Terms.

By accessing, purchasing, or otherwise using Paid Services, you agree to be bound by these Econ Terms. If you do not agree to these Econ Terms, then you may not access, purchase, or use Paid Services.

Paid Services & Payment Information

Overview

While there are no fees for the use of some aspects of the Services, The Peach Studio charges fees in connection with Paid Services. These include certain subscription products (“subscriptions”) made available through the Services under these Econ Terms.

Payment Information

We use third-party payment processors (Stripe, inc.) to process your Payment Information (our “Payment Partners”).

All payment is done through our Payment Partners. Please refer to their Terms and Conditions for how your payment information is collected and shared.

If you submit your Payment Information, you agree that:

• Your Payment Information is true and correct;
• You are authorized to use your Payment Information;
• You will pay for the Paid Services (including any applicable taxes, fees, and costs) by the payment due date;
• You give us and our Payment Partners permission to charge you for the Paid Services, using your Payment Information, when payment is due for the full amount of the purchase (including any applicable taxes, fees, and costs);
• We may retain and share your Payment Information with our Payment Partners in order to process your purchase of Paid Services; and
• We may retain and use your Payment Information (including any information about you and your Payment Information provided to us by our Payment Partners) to provide you with notices and disclosures relating to renewals, recurring charges, and changes affecting your purchase.

Your billing relationship will be directly with the applicable Payment Partner. Any fees charged for Paid Services will be billed by the applicable Payment Partner using the payment method you have provided that Payment Partner.

Changes to Fees

We may change the fees or benefits associated with Paid Services from time to time with reasonable advance notice of material changes. However, no advance notice will be required for temporary promotions, including temporary reductions in the fees associated with the Paid Services.

Discounts

We may offer discounts on Paid Services and the specific terms of each discount will be stated at the time the discount is offered. For example, if you are taking part in any trial period offer that enables you to use a subscription without charge, and that trial period converts into a paid subscription upon expiration of the trial period, then you must cancel the subscription prior to the end of the trial period in order to avoid incurring charges for the paid subscription.

Refund Policy

You have immediate access to, and use of, Paid Services you buy through the Services. As a result, all purchases are final, non-refundable, and non-returnable to the furthest extent permitted by law. We do not have an obligation to refund or credit for partially used billing periods.

Please note, however, that your right of withdrawal is lost when you purchase Paid Services that include: (a) a license to use digital services; or (b) a subscription. These Paid Services are provided to you once the digital services is credited to your Account or upon commencement of the subscription, and you request and consent to these Paid Services being provided to you in this manner immediately upon purchasing them.

Taxes & Fees

Peach Studio will charge applicable taxes and fees when required to do so, but it is your responsibility to pay for all applicable taxes and fees associated with your use of the Services and your access to and purchase and use of Paid Services, including transaction taxes, data plan fees, internet fees, and other similar costs.

Account Suspension or Termination

As stated in the User Agreement, you must follow and comply with the rules for our Services and the rules of the individual communities you participate in. Failure to do so may constitute a breach of these Econ Terms and result in a temporary or permanent ban from the Services. In such instances, you might lose the benefits of Paid Services, and we will not compensate you for this loss.

Your Acknowledgments

In connection with your access, purchase, or use of any subscription, or other Paid Services made available through the Services (collectively “Peach Studio Goods”) — you represent, warrant, acknowledge, and agree that:

• You will comply with Peach Studio Rules and Terms.
• You can’t transfer or sell Peach Studio Goods.
• Your rights to Peach Studio Goods are limited.
• You won’t commercialize any Peach Studio Goods.
• You won’t bypass any limits or security measures set by us
• You won’t extract data from Peach Studio Goods or the Services 
• You’ll comply with the law and use common sense
• You won’t encourage anyone else to violate these Terms & Agreement

Failure to follow and comply with the above rules may constitute a breach of these Econ Terms and result in a temporary or permanent ban from Peach Studio or certain communities or removal of your access to Peach Studio Goods. In such instances, you might lose the benefits of Peach Studio Goods, and we will not compensate you for this loss.

You Assume These Risks

In connection with your access to and purchase and use of any Peach Studio Goods, you acknowledge and assume, and will hold Peach Studio harmless from liability resulting or arising from, the following risks:

• Losing access to your Account
• Changes to Peach Studio Goods

You understand that your assumption of the above risks is a condition of your access to and use and purchase of Peach Studio Goods. If you do not agree to assume these risks, then you do not have our permission to access, purchase, or use any Peach Studio Goods.

Miscellaneous

Our User Agreement is incorporated by this reference into, and made a part of, these Econ Terms, and to the extent any User Agreement’s terms conflict with these Econ Terms, these Econ Terms governs with respect to your access to and purchase and use of Peach Studio Goods.
